Find a competent 3rd party repair shop or buy a new phone. Apple won't touch that one now that it's been tampered with.
it had already been opened before the shop told me so i knew it wasn't going to be in warranty anyway.
i did fit a new speaker and im competent, but the new speaker still refuses to work
Do earphones work?
yes
its also not stuck on headphone mode i can turn it up and down
iPhones are not user serviceable.
Apple does not sell iPhone parts.

We can't help you. Ask for help somewhere else, find a competent repair shop, or buy a new phone.
Frequently when stuck in headphone mode it is due to the little switch in the headphone jack sticking shut. Sometimes cleaning the jack with alcohol and inserting/taking out a headphone plug a dozen times or so help.
Also have you tried restoring to factory settings/new iPod since sometimes a software glitch can cause the device to be stuck in headphone mode.
im 99% sure its not in headphone mode as when i turn the volume up and down it doesnt say anything about headphones on the volume bar
Then take the device to a third-party repair place who knows what they are doing or live without the internal speaker.
